Frequently Asked Questions
Does BRS provide emergency service; Am I entitled to this?
In Massachusetts, insurance companies are required by law to pay for emergency mitigation services immediately in order to minimize the damage caused by an emergency such as a water flood. This is known as the "prompt payment" law. The law is in place to ensure that property owners can quickly take action to prevent further damage to their property in the event of an emergency.
The prompt payment law applies to all types of insurance policies, including homeowner's, commercial, and automobile insurance policies. It requires insurance companies to pay for reasonable and necessary expenses incurred as a result of an emergency, as long as the policy covers the damage. This means that if an insurance policy covers water damage, the insurance company must pay for emergency mitigation services such as water extraction, drying, and dehumidification.
The reason for this is that the prompt payment law recognizes that time is of the essence in emergency situations, and that delaying the start of mitigation efforts can lead to much more extensive and costly damage. By requiring insurance companies to pay for emergency mitigation immediately, the law helps to ensure that property owners can take the necessary steps to minimize damage to their property as soon as possible.
It's also worth noting that the prompt payment law also requires insurance companies to pay for emergency mitigation services even if a claim has not yet been fully processed. This means that insurance companies are required to advance funds for emergency mitigation services, even if the policyholder has not yet submitted a claim.
